Terms of Use
Draft 0.1, updated October 28, 2026
1. Scope
These Terms constitute an agreement between Công ty Cổ phần Giải pháp NEXT HOME (NEXT HOME, hereinafter also "we") and a business that registers to use TingStay, as well as the persons to whom that business grants accounts.
TingStay consists of the following components, collectively referred to as the "Services":
- The browser-based operations Console (console.stayops.vn).
- The staff application and the guest pages opened via a link.
- The TingEdge installed in each unit and the software running on it.
- Connections to door locks, booking channels, banks and other third-party services.
By signing in to or using the Services, you confirm that you have read, understood and agreed to these Terms and to the Privacy Policy. If the Business has signed a separate contract with NEXT HOME, any provision of that contract that differs from these Terms prevails.
2. Definitions
- Business: an organization or household business that registers to use TingStay to operate its accommodation establishment.
- User: the owner, managers, front desk staff, housekeeping staff, technicians, accountants, contractors and any other persons to whom the Business grants an account.
- Guest: a tenant or occupant of a unit operated by the Business.
- Operational Data: information that the Business and Users enter into, or that is generated through use of, the Services, including the unit list, stays, guests, receipts and payments, housekeeping tasks, device readings and activity logs.
- Service Plan: the feature tier the Business is using (Basic, Start, Pro, Enterprise), according to the price list published at tingstay.vn or the contract.
3. Accounts and sign-in
- User accounts are created and assigned permissions by the Business. NEXT HOME does not issue accounts to the Business's staff on its own initiative.
- Users must keep their passwords confidential, must not share their accounts with others, and must sign out when using a shared computer.
- Every action performed using an account is deemed to have been performed by the holder of that account until NEXT HOME or the Business receives notice that the account has been compromised.
- If a User suspects that an account has been compromised, the User must notify the Business's manager immediately. The Business is responsible for revoking or suspending the accounts of persons who have left, whose contracts have ended or who no longer need access.
- NEXT HOME may temporarily lock an account upon detecting signs of unauthorized access, and will notify the Business as soon as possible.
4. Service Plans, fees and trial
- Service fees are charged based on the number of active TingEdge units and the Service Plan selected by the Business, according to the published price list or the contract. Prices exclude value added tax.
- The Business pays monthly or annually, by the due date stated in the fee notice.
- The trial period of the Pro plan (if any) is confirmed by NEXT HOME upon activation of the TingEdge.
- If a paid plan term expires without renewal, the account automatically reverts to the Basic plan. Operational Data is retained in full, and features outside the Basic plan are suspended until renewal.
- Fees paid are non-refundable, unless otherwise agreed in the contract or the fault lies with NEXT HOME.
5. Responsibilities of the Business
- Provide accurate registration information and update it when it changes.
- Comply with the law on accommodation services, including guest registration (residence notification) under the Law on Residence. TingStay supports record keeping but does not perform this obligation on behalf of the Business.
- Act as the controller of the personal data of Guests and staff that the Business enters into TingStay: notify Guests of the collection, have an appropriate legal basis for the collection, and collect only the information necessary for the stay.
- Use data from sensors, door locks and meters only to operate units, ensure safety and bill electricity and water. Such data must not be used to monitor the private lives of Guests.
- Grant Users only the permissions necessary for their work.
- Prepare a fallback so that guests can enter the unit if a device fails, for example a mechanical key or a backup code held by an authorized person.
6. Prohibited conduct
The Business and Users must not:
- Access or attempt to access the data of another business, or scan, attack or overload the system.
- Copy, reverse engineer or modify the software of TingStay and the TingEdge, except as permitted by law.
- Upload malicious code, unlawful content or content that infringes the rights of others.
- Use the Services to collect, buy, sell or share personal data unlawfully.
- Resell or sublicense the Services without a written agreement with NEXT HOME.
7. Devices and remote control
- Remote control commands (unlocking doors, switching power, air conditioning, issuing door codes) travel over the internet to the TingEdge in the unit. Commands may be delayed or fail in the event of a power outage, network outage or device failure. The screen always shows the actual result reported by the TingEdge.
- Automated scenes in the unit and door codes already issued continue to work without internet access. The TingEdge sends the buffered data once the connection is restored.
- The Business must not remove, rewire or update the software of the TingEdge other than as instructed by NEXT HOME.
- Hardware warranty is governed by the warranty policy of the device and the equipment supply contract.
8. Third-party services
Some features connect to third-party services such as door lock platforms (TTLock, NeoLock), booking channels, Zalo and banks (VietQR codes). When the Business enables these connections, use of those services is also subject to the third party's own terms. NEXT HOME is not responsible for interruptions or changes on the third party's side, but will assist the Business in resolving them to the extent possible.
9. Operational Data
- Operational Data belongs to the Business. NEXT HOME processes this data only to provide, maintain, protect and improve the Services, in accordance with the Privacy Policy.
- The Business may export reports and lists as files at any time during the term of use.
- Upon termination of use, the Business has 30 days to request an export of all data. After this period, NEXT HOME deletes or anonymizes the data, except for any part that the law requires to be retained.
- NEXT HOME may use anonymized aggregate figures, from which no Business or individual can be identified, for statistics and product improvement.
10. Intellectual property
The software, interfaces, user documentation and the TingStay and NEXT HOME trademarks are owned by NEXT HOME or its licensors. The Business has the right to use the Services for the term and within the scope of its Service Plan, and may not transfer this right to any other party. NEXT HOME may use the Business's feedback on the product for improvements without incurring any payment obligation.
11. Availability and support
- NEXT HOME uses reasonable efforts to keep the Services running continuously. Maintenance that affects use is announced in advance on the Console.
- A service level agreement (SLA) with specific figures applies only where it is included in the contract, for example for the Enterprise plan.
- Support is provided by phone, Zalo and the technical teams in Hanoi, Hai Phong and Da Nang during published business hours.
12. Limitation of liability
- NEXT HOME is not liable for indirect damages, such as loss of revenue or loss of business opportunity, arising from temporary interruption of the Services, except where caused by the intentional fault or gross negligence of NEXT HOME.
- The total liability of NEXT HOME for compensation in any event shall not exceed the total service fees paid by the Business in the 12 months preceding the event giving rise to the damage.
- NEXT HOME is not liable for damage arising from a breach of these Terms by the Business or a User, disclosure of passwords, or force majeure events such as natural disasters, fire, widespread network failures or decisions of state authorities.
13. Suspension and termination
- The Business may stop using the Services at any time by notifying NEXT HOME. Fees for a paid term are governed by the section Service Plans, fees and trial.
- NEXT HOME may suspend the Services if the Business is overdue on payment after a reminder, or breaches the section Prohibited conduct. NEXT HOME gives prior notice, except where immediate action is needed to prevent damage to the system or to others.
- Upon termination, data is handled in accordance with the section Operational Data.
14. Changes to these Terms
NEXT HOME may update these Terms when the Services or the law change. Material changes are announced on the Console or by email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance of the new terms.
15. Governing law and dispute resolution
These Terms are governed by the laws of Vietnam. Disputes are to be resolved first by negotiation. If no settlement is reached within 30 days from the date one party sends a request, either party may bring the dispute before the competent People's Court in Hanoi.
